Don’t steal. This principle of human behavior has been widely held for centuries. The principle prominently appears in the Ten Commandments in the Old Testament’s Book of Exodus. Chapter 20 addresses the followers of God and proclaims, â€Å"You shall not steal† directly following â€Å"You shall not murder† and â€Å"You shall not commit adultery† (Exodus 20.13-15). Thou shall not steal is not only prominent in the Bible and the Christian religion, but it is widely maintained in cultures around the world, specifically the United States, as a standard of honesty. Throughout the US, federal, state, and local laws prohibit stealing or the act of theft, and techniques such as security personnel and cameras have been employed to thwart stealing minor items†¦show more content†¦The answer in the majority of situations, is yes. Statistically, 10 million people have been caught shoplifting in the past five years. However, the rate of being caught is only 1 in 48 shoplifts, and caught shoplifters are only turned over to the police 50 percent of the time (NASP). This rate is not high, but 10 million peoples’ lives have been affected. Overall the risk of getting caught is there, but not exorbitant for the non-habitual shoplifter. Other costs beyond those posed to the agent shoplifter include criminal justice procedures and the costs of the stolen good to the vendor. The criminal justice costs are countered by fines assessed to those taken in by police. However, the costs imposed to a store are not countered, and amount to $13 billion in goods per year, or $35 million per day (NASP). Although that cost is not small, it is inflated by the 3 percent of shoplifters who are considered professionals and contribute to 10 percent of the $13 billion. Professional shoplifting is surely immoral, so we will discount the number by such. Thus, the cost of solo shoplifters is roughly $11.7 billion (NASP). This cost is clearly large and amounts to the majority of the costs of shoplifting outside of the risk to the shoplifters themselves. Hong Kong is reported to have ceded to the British and became the most favored nation treatment from China. Consequently, the chapter also talks about the Chinese in the Diaspora. It indicates that there was out-migration from China into the other areas of Southeast Asia. Ben who was among the fishermen got the rumor from a stranger who was fishing besides him just few minutes before Catching Lord Harry. A certification was made by a representative of Mojo Beverage but he did not make any comment on the amount to be rewarded therefore ben is claiming that Mojo owes him Advise Mojo Beverage, explaining applicable legal principles and citing relevant authorities. In this case Mojo Beverage placed an advertisement in local newspaper for local people to accept and participate in that open challenge to catch that fish named Lord Harry and that person will get a reward of $100,000. So there was a huge difference between the amounts of reward. A representative of Mojo beverage supposed to clear that things but he did not say anything about the amount of the price before releasing Lord Harry into the lake. The right of consumers and the fair trade is protected in Australia by the ACL. Engaging in misleading advertisement or misleading conduct is highly prohibited and heavy penalties taken this is in accordance to section of the ACL. Meaning that when the reward is reduced from $ 100,000 to $ 1,000. The false statement shown in advertisement was the reason of reduction in the price. Mojo Beverage changed their statement that original price of reward is $1,000. Then Mojo Beverage will be considered as the victim of misleading conduct. This reduction in amount of price creates a huge economic difference in price since it is scarce for suppliers who provide goods and services. This change in price will affect all the other parties who were participating in this game. The composition of trade amendment act was passed by both the parliament houses but the royal assent was received on unfair contract (Paterson, 2012). Mojo Beverage is having a risk of being fined by court of up to $1.1 millio n if they give $1,000 to Ben instead of giving him the price shown in the advertisement by Mojo Beverage which is $100,000 and they have to face a lots of problems such as redress and public warning hence they should pay $100,000 to Ben which was claimed by him after winning that competition. Julia Rowe DANC 221 Critical Analysis Paper- Rough Draft The Mark Morris Dance Group performed a spectacular concert at Cal Poly ' s Performing Arts Center on May 10, 2016. Mark Morris is a world-famous choreographer of modern and contemporary styles. The choreography for this performance overall lacked athleticism, however, there were other obscure techniques and strategies that took place to keep the audience entertained throughout the entire concert. Although some concepts may have been difficult to interpret, the three pieces of the concert successfully compelled the audience through differentiating themes of body language , humor, and aesthetic appeal. The first piece, called " Words, " seemed to be experimenting with the idea of conveying an emotion or mood without the use of actual words. The live music that accompanied this piece included a violin and piano, with no corresponding lyrics. There were many pair work where dancers would vary o n use of face expression, personal space, and movement to portray types of relationships between dancers. These movements and body languages conveyed many emotions such as happiness, longing, disappointment, and playfulness which were interrupted with a grey sheet. This grey sheet carried by two dancers, moved across the stage to mark the end of a scene and a beginning of another. Even this grey sheet evoked mixed feelings of sadness of a scene ending and an excitement of what will happen in the next. The following piece may have been the audience ' s favorite piece of the concert because the intended humor was well understood by the crowd. The odd lyrics from Ivor Cutler were represented by dancers ' pedestrian-like movements, gestures, and pantomime that visualized the words and sounds in the music. For instance, an incomplete word phrase of " a pain in the " was immediately followed by a women on downstage center focusing the audience ' s attention to h er behind. The audience loved this as well as when the lyrics said " I don't know what love is, I don ' t either, " while a male and female dancer were interacting with each other. Although there were many deeper meanings of the lyrics, the audience seemed to only understand the surface of it, hence the ongoing laughter throughout the piece. " The Grand Duo " was the closing piece of the night, which had an aesthetic appeal and beauty through a unison of shapes and motifs. Unlike the previous two pieces, the fourteen dancers remained on stage while making slight variations on movement phrases. In the beginning, the dancers started with one finger pointing straight above, flickering like a small flame on a candle. Another repeated motif was an L-shape of the arms with a deep pli e . All dancers executed both of these repeated movements with variations on speed, level, and direction, but still seemed to bring a sense of unity. Along with this, the green, p urple, and blue costumes made of a silky material had an effect of illustrating a painted artwork.

To apply to a Haas School of Business program, you should have some work experience. Students in the Full-Time MBA and EWMBA program typically have at least two years of work experience, with most students having five years or more. Humans need to act morally, but it is not a quality needed for contemplation. To contemplate means to admire something, or think about something. I believe that to be truly moral, you often have to contemplate your morals and know what you stand for and believe in. 	Francesco Petrarch, was a man held in high regards of his peers. The life in which Petrarch lived, was certainly not one of which many people could have had dealt with. A life of solitude, misplaced love and, family misfortune that was endured. But, through hard workand perseverance, loyalty to the churches which lead to good connections, he was regarded as one of the most influential persons and authors of his time. 	Petrarch was not a man with greatest of family lives. Born in Arezzo in 1304, to a family that had just been exiled from Florence, his family had to move to Incisa, Tuscany. Petrarch spent most of his childhood in Incisa. From then on, his father pushed him into the path of law. His brother, Gheredo, the most stable family figure in his life, later became a monk and throughout his life stayed in contact with Francesco. Petrarch had another brother, who died at a very young age. His mother died when he was 15 years old, which was consequently when some of his earliest works have been recorded. At the age of 22, Francesco's father passed away, which caused Francesco to attain a career. Giovanni, his son, was born illegitimately in 1337. The relationship between the two was disappointment to Francesco. He describes him as: "Intelligent, perhaps even exceptionally intelligent, but he hates books" He let Giovanni live with him till he could no longer stand the sight of him and sent him to live in Avignon, at the age of 20. It wasn't until just before Giovanni's death, of the Black Plague, did they start to write each other. Just before his sons death, Petrarch's friends though of Giovanni as a good person and wrote Petrarch about this. He never saw his son before his death but in his mind knew that he had started to get his life back together. He also had a daughter, Francesca, she gave birth to Petrarch's grandchildren one of which died during the Plague. This was of great disheartenment of Petrarch. 	Much to Petrarch's dismay he studied law at the University of Bologna and he earned his degree. Beyond the levels of his peers at an early age it was obvious the intellectual presents he had. Moving from school to school he realized that his true interests were in the ancient authors, not the law. He sought out and recovered manuscripts' Cicero, Virgil, amongst others. Managers need to take into account that constructing schedules will impact stakeholders in different ways (Collier & Evans, 2013). Where a quicker delivery time might make a customer happy, a salaried employee working 14 hour days to meet that demand may ultimately be causing more harm to the company in the long run. One of the best methods for developing schedules is an Activity-on-Node model. In this model, we can see the earliest start (ES) latest start (LS) earliest finish (LS) and latest finish for each activity of the project. Some of they may be able to run concurrently, which leads us to determining what the â€Å"critical path† would be. Deming’s steps 13 (Encourage Education and Self-Improvement) and 14 (Take Action) are the two that I find the most respectable attributes in operations managers and normal managers, alike. I have seen first-hand what sort of morale detriment can occur when self-improvement and education are not fostered in top-performers. For example, employee John Smith decides  he wants to obtain his Project Management Professional PMPâ„ ¢ certification. His company has a training budget that allows for such training, but Smith’s manager cannot rationalize the need for the certification, based on Smith’s current duties. Smith then decides to take vacation time and pay out of pocket to achieve this certification, nearly $2000 of his own money spent on professional development. Several months later, Smith’s company is awarded a substantial Earned Value (EV) contract from the DoD, in which a requirement was that there needed to be a certified PMPâ„ ¢ on the project team. Smith’s manager lacked the foresight to see the benefit of such a certification, and to this day, Smith has not been formally reimbursed for what ultimately led to the acquisition of a multi-million dollar contract. Needless to say, Smith’s regard for that manager severely diminished. Taking Action stood out to me as well, because I have seen what cost-plus contracts can do to a company. The â€Å"chaos is cash† mindset that melds into the minds of managers whose incumbencies are those contracts can be sickening. I once witnessed a company with a directorate that was so focused on this mind-set that deliveries were constantly late or with error, and it was considered the norm to have such things occur. DoD contractors are normally evaluated by the Contractor Performance Assessment Reporting System (CPARS), and this company was consistently in the unsatisfactory rating. With a new directorate and management, this company was able to climb that rating system two levels for the first time in over a decade. I attribute this to those whom replaced the previous directorate and managements â€Å"Take Action† attitude in correcting that horrific â€Å"cost-plus† mindset. 3) Explain how service quality is measured. Specifically, discuss how you may have experienced each of the five SERVQUAL dimensions as a consumer of services. â€Å"Service quality is consistently meeting or exceeding customer expectations (external focus) and service-delivery system performance criteria (internal focus) during all service encounters† Collier & Evans, 2013). With understanding/knowing the customer, I would say Pacific Caliber is high on my list. We at Pacific Caliber can recognize the true, earned-value potential in the candidates we place with our clients, because we have been subject matter experts in those fields already. An approach to aspects of a child abuse investigation in a modern society using police and community cooperation (A reference to the media)   Ã‚   As traditional communities erode and our societies become more diverse, feelings of insecurity grow, fear of crime increases and questions of identity and citizenship come in question A threat on the safety of our children has culminated to an investigation into the cause and the socio-political aspects of the problem. Our law officers and the stakeholders of the social welfare are investigating and researching on various socio perspectives and trends that are described as possible factors leading to the problem. It’s not commonplace in this society to have incidents of child abuse and as such we are working towards stemming down any possible link and also address the problem collectively through arresting those perpetrating such crimes.   Ã‚   Out of every ten children in our community one of them has reported abuse or aggressive behaviour. 17% of the children report that their attackers were burly or sickly looking. 25% of the children are now afraid of venturing into the neighbourhood. The rate of these abuses has rose up with up to 11% which is a considerable rate.    We have checked on any psychopathic connections to the few cases that have been reported. We are also evaluating theories and investigating curtails that have suspect characters that are substance abusers and their possible involvement. We are comprehensively analyzing socio-economic factors as well as ideological issues which could be eliciting the problem. We believe some people might have ideologies which force them to think and argue that children rights and safety are not important. These ideologies result to hate against children. We also view childless individuals who have developed frustration and stress levels might be involved due to obsession with the idea of harassing other people’s children due to this frustration.      We are establishing stereotyping, class and other social factors which have negative impacts on children social groups. Apart from these theories we understand victimisation based on family and social feuds might victimise children. We are working on looking into any possibilities of parents, select social classes, estate neighbourhoods and school based feuds as being the cause of the problem. Some disgruntled parents or neighbours might be trying to settle scores, seek payment of a debt, drug money and illicit business dealings and other bad dealings gone sour might be causes. We attribute rise in crime and related social anomalies to changes in economic structure are altering the pattern of regional inequalities (UNICEF 2006).    On the other hand we blame radical political changes on the faà §ade of some expression values, especially in the fourth estate. Too much exposure of various aspects of the judicial system acts to people with criminal intent has increased affableness to crime due to the knowledge and criticism on aspects of legislation and police action on the issues as well as the legal loopholes. We are encouraging more concise and distinctive media education and publishing in judicial and social values content so that we can have a responsible and safe society. Bell X-1 Design Development: Development of the Bell X-1 began in the waning days of World War II as the interest in transonic flight increased. Initially contacted by the US Army Air Force and the National Advisory Committee for Aeronautics (NACA - now NASA) on March 16, 1945, Bell Aircraft began designing an experimental aircraft dubbed the XS-1 (Experimental, Supersonic). In seeking inspiration for their new aircraft, the engineers at Bell elected use a shape similar to a Browning .50-caliber bullet. This was done as it was known that this round was stable in supersonic flight. Pressing forward, they added short, highly-reinforced wings as well as a movable horizontal tailplane. This latter feature was included to give the pilot increased control at high speeds and later became a standard feature on American aircraft capable of transonic speeds. In the interest of retaining the sleek, bullet shape, Bells designers elected to use a sloped windscreen in lieu of a more traditional canopy. As a result, the pilot entered and exited the aircraft through a hatch in the side. To power the aircraft, Bell selected an XLR-11 rocket engine capable of around 4-5 minutes of powered flight. Bell X-1 Program: Never intended for production, Bell constructed three X-1s for the USAAF and NACA. The first began glide flights over Pinecastle Army Airfield on January 25, 1946. Flown by Bells chief test pilot, Jack Woolams, the aircraft made nine glide flights before being returned to Bell for modifications. Following Woolams death during practice for the National Air Races, the X-1 moved to Muroc Army Air Field (Edwards Air Force Base) to begin powered test flights. As the X-1 was not capable of taking off on its own, it was carried aloft by a modified B-29 Superfortress. With Bell test pilot Chalmers Slick Goodlin at the controls, the X-1 made 26 flights between September 1946 and June 1947. During these tests, Bell took a very conservative approach, only increasing speed by 0.02 Mach per flight. Dismayed by Bells slow progress towards breaking the sound barrier, the USAAF took over the program on June 24, 1947, after Goodlin demanded a $150,000 bonus for achieving Mach 1 and hazard pay for every second spent over 0.85 Mach. Removing Goodlin, the Army Air Force Flight Test Division assigned Captain Charles Chuck Yeager to the project. Familiarizing himself with the aircraft Yeager made several test flights in the X-1 and steadily pushed the aircraft towards the sound barrier. On October 14, 1947, less than a month after the US Air Force became a separate service, Yeager broke the sound barrier while flying X-1-1 (serial #46-062). Dubbing his plane Glamorous Glennis in honor of his wife, Yeager achieved a speed of Mach 1.06 (807.2 mph) at 43,000 feet. A publicity boon for the new service, Yeager, Larry Bell (Bell Aircraft), and John Stack (NACA) were awarded with the 1947 Collier Trophy by the National Aeronautics Association. Yeager continued with the program and made 28 more flights in Glamorous Glennis. The most notable of these was on March 26, 1948, when he reached a speed of Mach 1.45 (957 mph). With the success of the X-1 program, the USAF worked with Bell to build modified versions of the aircraft. The first of these, the X-1A, was intended to test aerodynamic phenomena at speeds above Mach 2. First flying in 1953, Yeager piloted one to a new record speed of Mach 2.44 (1,620 mph) on December 12 of that year. This flight broke the mark (Mach 2.005) set by Scott Crossfield in the Douglas Skyrocket on November 20. In 1954, the X-1B began flight testing. Similar to the X-1A, the B variant possessed a modified wing and was used for high speed testing until it was turned over to NACA. In this new role, it was used until 1958. Among the technology tested on the X-1B was a directional rocket system that was later incorporated into the X-15. Designs were created for the X-1C and X-1D, however the former was never built and the latter, meant for use in heat transfer research, only made one flight. The first radical change to the X-1 design came with the creation of the X-1E. Constructed from one of the original X-1s, the X-1E featured a knife-edge windscreen, new fuel system, a re-profiled wing, and enhanced data collection equipment. First flying in 1955, with USAF test pilot Joe Walker at the controls, the aircraft flew until 1958. During its final five flights it was piloted by NACA research pilot John B. McKay who was attempting to break Mach 3. The grounding of the X-1E in November 1958, brought the X-1 program to a close. Adverb clauses show the relationship and relative importance of ideas in our sentences. From Coordination to Subordination Consider how we might combine these two sentences: The national speed limit was repealed.Road accidents have increased sharply. One option is to coordinate the two sentences: The national speed limit was repealed, and road accidents have increased sharply. Coordination with and allows us to connect the two main clauses, but it doesnt clearly identify the relationship between the ideas in those clauses. To clarify that relationship, we may choose to change the first main clause into an adverb clause: Since the national speed limit was repealed, road accidents have increased sharply. In this version the time relationship is emphasized. By changing the first word in the adverb clause (a word called a subordinating conjunction), we can establish a different relationshipone of cause: Because the national speed limit was repealed, road accidents have increased sharply. Notice that an adverb clause, like an adjective clause, contains its own subject and predicate, but it must be subordinated to a main clause to make sense. Software Requirements The software I choose must be able to: Â  Import pictures, so that I can actually create the logo. Â  Move and edit pictures, so that the logo can be tweaked, and the pictures do not stay as their original. Input text, so that the logo has text as well as pictures and so the name Mercury Entertainment can be on the logo. Shade pictures, so that I can make the logo look and have a professional feel. Â  Overlap and underlay objects, again to create a stylish look, and make the logo look the best it can. Change the text colour, font, and size, so that I do not have to keep boring Arial text, and can make a good logo. Â  Convert to pictures, so that I can save the copy as a jpeg file, to save space and time loading the original file, and then copying it from there. I could produce the logo using a word processor. This is a limited, but simple way of doing the logo. It can do everything above, apart from edit pictures in the way that other programs can do. It can wrap text, and edit the brightness, but it cannot edit pictures in the most expert technique that I want, for example, fading different parts of the graphic, or overlapping objects. It would be able to produce the logo, but it might not be as good as if I used another program. I need it to look the best I can because I want to promote the business as much as possible. I could produce the logo using MS Paint , but this a very basic program, more so than the word processor. It does not have import feature, but you can use traditional copy and paste. It cannot overlap and underlay objects with a toolbar button, but of course, you will be able to by just placing one graphic over another. It cannot convert graphics to pictures either; well I cannot find a tool for it. I will produce the logo using Serif PagePlus 8, because it is the most expert program that I have to choose from, and it will help me to create the logo to the full quality. It can import pictures through the typical copy and paste, and through Insert Picture. It can move pictures through the normal method, by clicking and holding the left mouse button over the picture and then dragging it to where you want it to be. It can input text through the keyboard, just as any other program does. To shade a picture, you must highlight the picture and then click on the attributes tab on the right. Then there is a shade slide bar on the bottom, which you can slide to the right to shade lighter and right for heavier. It can over and under lap objects with the two buttons on the arrange toolbar, at the top: With these, the left sends the item to the back, and the right one brings the picture to the front. Text is edited in the standard way, by the toolbar at the top, or by clicking Format Character. It can convert things to pictures. You have to highlight the certain graphics you want to be a picture, and then click Tools Convert to Picture It will then come up with a box: Select JPEG from the combo box, as it provides a picture with small file size, and therefore easiest and fastest to work with. After this, it will be converted to a jpeg; however, it will be inside the page plus publication. To export the picture so that it is a new file, highlight the picture, and click File Export As Picture This will then open a new window, enabling you to save the picture as a certain format. I chose JPEG, because it has the smallest compression size at a 24-bit format. This will enable me to use it quickly and efficiently. Conclusion I am going to use Serif Page plus 8 for my logo, as it is the most professional and enables me to do things in which a word processor and MS Paint cannot. It is much easier to use from a graphic point of view, and it is not hard to put in text. I also know much more about it than I do a word processor or MS Paint, which makes it easier to work with. That means, if I use a word processor or MS Paint, it will be very time-consuming to find out how to do things that I am not sure about doing. Outline Plan I will type Mercury Entertainment straight into the package in a logo art format, so that it is more eye-catching, and can be changed to different shapes and colours, and can have shadows and backgrounds. I will get my graphics from Microsoft Office Design Gallery. This is because it has a wide selection of clipart and graphics, all available for download. I will bring them onto the page by copy and paste. When you download it, the picture appears in the clipart window, and you can easily highlight it, and then copy (Ctrl + C) and then go to the Page plus 8 windows and press (Ctrl + V) to import it onto the display. I will probably use Times New Roman, as it is the easiest to read, and the default font, that is not that boring. See below. How The Turbo Unit Works The Compressor Side To keep it brief and simple, a turbo unit compresses the intake of the engine by means of a fan. Essentially, the fan pulls in air on one side and then it pushes it out the other (see diagram A, here it's referred to as the compressor wheel). A fan performs the function of moving air; however we are still left with the task of compressing the air. In order to compress the air; we must then contain it within an enclosed space (this is the compressor housing). Once the intake is compressed it gets sent out to the engine. This process of compression is what's technically referred to as "boost". When one is running more "boost" this person is essentially running more compressed air out of his turbo unit. This is usually related to the size of the unit itself. However, certain factors can limit the degree to which boost varies with the size of the unit. As this gets too technical within the scope of the article, I will leave it to a later discussion. The Turbine Side So far we understand how the compressor side allows for more air to flow into the engine, but we must now understand what it is that makes the compressor wheel turn fast enough to create the boost in the first place. In turn, we are brought into the turbine side. A turbine is a term used to describe a fan like object that gets propelled by the flow of air, water or steam. In a hydroelectric power plant, the Turbine is propelled by the flow of water which then turns a generator. Within the scope of the turbo charger, the turbine is propelled by the flow of exhaust gases that come out of the engine. So the more exhaust that flows out of the engine, the faster the turbine will turn. Again, like the intake side, pressure can only be created if the flow of air is kept within an enclosed space; for this reason, we have the turbine housing. Ups and Downs of Turbo Chargers While the turbo unit does provide ample cranking power, it is very dependant on the reciprocating process which I described earlier. Contract and Chou Essay

The case scenario under review by our team includes a contract law situation involving a board game company and a game inventor. Big Time Toymaker (BTT) is a board game company which develops, manufactures, and distributes board games, and Chou is the name of the inventor of a new strategy game. In this scenario, what began with a payment made from BTT to Chou for exclusive negotiating rights for 90 days, ended in a change in management at BTT, leading to their company no longer having interest in distributing Chou’s game. Several questions will be asked about the validity of the terms agreed upon by the parties involved, including at what point did the parties have a contract, and what role does the statute of frauds play in this contract? Our objective is to analyze the case scenario, including the previously stated questions, and provide the answers to those and other questions pertaining to the scenario and contract law. Question 1 At what point, if ever, did the parties have a contract? There was mutual agreement between Chou and BTT via verbal agreement, and a subsequent email verifying that an agreement had been tentatively reached. According to the terms of distribution between Chou and BTT a contract was only valid if formalized in writing. An argument may be made that three days prior to the 90 day time limit a mutual agreement was reached and valid via an E-contract law. There was mutual assent between both Chou and BTT. The argument for the other side will state there was never a formalized written contract from either Chou or BTT, only an email with a subject heading stating Strat Deal. Is the email a valid contract? Question 2 What facts may weigh in favor of or against Chou in terms of parties’ objective intent to contract? Facts show that BTT sent an email with a subject heading of Strat Deal with information stating that Chou and BTT have reached an agreement. The writing states that after months of no response from BTT and with no management in place the company no longer wishes to distribute Chou’s intellectual property. Chou was in compliance with BTT at all times regarding issues pertaining to Strat. Chou will allege that there was a contract between himself and BTT that was of mutual assent and under E-contract law the emails were valid. Question 3 Does the fact that the parties were communicating by email have any impact on your analysis in questions 1-2 above? According to CA Civil Code 1624, b 3, a, online contracts are endorsable even if writing is required by the statute of frauds. Communication of contracts is valid under E-contract law. There is no impact on analysis made of above stated questions because of online communication. Question 4 What role does the statute of frauds play in this contract? A key factor in any contract is acceptance, and in this case a verbal agreement had been reached three days before the exclusive negotiation right was expired. Chou then said he was going to draw up the contract. Big Time Toymaker (BTT) then sent Chou an email outlining all of the things that they had agreed upon that would be included in the contract. Seeing the email, Chou then assumed that this was the contract to be enforced and did not respond to BTT. Even though Chou received the email, he did not respond to it, thereby giving Chou the defense that silence is never acceptance. However, in E-contact law dictated by CA Civil Code 1624, b, 3, a, it says that online contracts are endorsable even if writing is required by the statute of frauds. In addition, the â€Å"Click On† or â€Å"Click Wrap† agreement clause states that these agreements are enforceable since the opportunity to read and acknowledge was given. The statutes of frauds do play a part in this contract due to the Uniform Commercial Code requiring that the statute of frauds applies to any contract for the sale of goods for $500 or more. However, the exact amount of â€Å"Strat† units that Big Time Toymaker (BTT) will sell or at what cost of each unit is unclear to the reader, it was described in detail in the email BTT sent to Chou. Question 5 Could BTT avoid this contract under the doctrine of mistake? Explain. The new management at BTT cannot avoid this contract under the doctrine of mistake because a mistake was not made by both Chou and the old management team. The mistake by Chou was accepting the email outline of the contract terms as an actual contract agreed to by both parties. Scienter applies to Chou in this case by accepting a seemingly legitimate contract. Would either party have any other defenses that would allow the contract to be avoided? The change of management brought about individuals bound to the same company as the old management team was, therefore, scienter applies to the new management team in privity. The draft sent from Chou and received by BTT is a negotiable instrument. BTT thereby becomes a holder in due course. The inaction of BTT after the draft was sent is in violation of the UCC requirement that all offers are to be open for a reasonable period of 90 days. Chou was under the impression that a contract had been made before that 90 days had expired. Chou has real defense as well as personal defense due to breach of contract and fraud. Question 6 Assuming, arguendo, that this e-mail does constitute an agreement, what consideration supports this agreement? By law, statute of frauds would support this agreement. Due to the terms, there cannot be a lawsuit that can be upheld on particular contracts or arrangements, except if it is written and signed by the authorized party or representative. Under the statute, certain kinds of contracts have to be in writing in order to be enforceable in a court of law (Contracts: Statute of Frauds, 2013). The writing also has to be signed by the person who is held responsible for the contract or by that person’s agent. To evade the justification of the Statute of Frauds, one would need to make sure the contracts are in text and signed by the other party; so, if the opposing party does not hold his or her end of the agreement, one would gain from that particular party. Question Assuming BTT and Chou have a contract, and BTT has breached the contract by not distributing the game, discuss what remedies might or might not apply. It is obvious BTT’s manager did not think clearly about protecting BTT from liability. He carelessly wrote the emails, and his careless actions put BTT at risk. This led Chou to believe that this e-mail was meant to replace the earlier notion that he should draft a contract. Although the word contract was not ever used in the e-mail, it said that all of the terms had been agreed upon. The compensation would be awarded to Chou by the court in a civil action due to the wrongful conduct, being the breach from the other party, BTT. If the contract is breached by BTT, Chou will be granted equitable relief by the court, which comes in the form of specific performance, injunctive relief, or reformation. Monetary damages could also be in effect, in which they can be compensatory, resulting from a loss due to nonperformance. Also, consequential, which are indirect but to be expected from non-completion. Restitution would also take place that would be equivalent to total the party has been unfairly supplemented by the non-breaching party, and liquidated, which damages are a preset value rendering from the agreement. The compensatory damages for recovery Chou suffered by the non-breaching party would be the damages that would be awarded to the party in the same situation he would have been in if the other party had executed as agreed upon (Melvin, 2011). After review of the case scenario involving Big Time Toymaker and Chou the game inventor, we have concluded that not only was there a contract agreement between the parties, but that according to E-contract law, Chou may be bound by the terms included in the original email sent from BTT. In addition, the doctrine of mistake cannot be used in this situation because of scienter toward Chou and the old and new management of BTT. Several questions were asked of our team in accordance with contract law and the scenario provided by the textbook. This completes our analysis of the scenario and answers to the questions we were presented.

The two princes of Andorra are the president of France and the Bishop Seu dUrgell of Spain. These princes are represented in Andorra via representatives from each and make up the countrys executive branch of government. The legislative branch in Andorra consists of a unicameral General Council of the Valleys, whose members are elected via popular election. Its judicial branch is made up of the Tribunal of Judges, Tribunal of the Courts, the Supreme Court of Justice of Andorra, the Supreme Council of Justice and the Constitutional Tribunal. Andorra is divided into seven different parishes for local administration.Economics and Land Use in AndorraAndorra has a relatively small, well-develop ed economy that is based mainly on tourism, commerce and the financial industry. The main industries in Andorra are cattle, timber, banking, tobacco and furniture manufacturing. Tourism is also a major part of Andorras economy and it is estimated that around nine million people visit the tiny country each year. Agriculture is also practiced in Andorra but it is limited because of its rugged topography. The main agricultural products of the country are rye, wheat, barley, vegetables and sheep.Geography and Climate of AndorraAndorra is located in southwestern Europe on the border between France and Spain. It is one of the worlds smallest countries with an area of just 180 square miles (468 sq km). Most of Andorras topography consists of rugged mountains (the Pyrenees Mountains) and very small, narrow valleys between the peaks. The highest point in the country is Pic de Coma Pedrosa at 9,665 feet (2,946 m), while the lowest is Riu Runer at 2,756 feet (840 m).The climate of Andorra is considered temperate and it generally has cold, snowy winters and warm, dry summer s.
